Terms of Service

1. Acceptance of Terms

By accessing or using BlueWeb's email intelligence platform, website, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

BlueWeb provides an email intelligence platform that enables users to find professional email addresses, verify email deliverability, discover company contacts, manage lead lists, enrich contact data, and send email campaigns. The Service is available via our web application, REST API, and integrations.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including API keys. You are responsible for all activity that occurs under your account.

You must be at least 18 years of age to create an account. Each individual may only maintain one free account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to send unsolicited bulk email (spam) in violation of applicable anti-spam laws, including CAN-SPAM, GDPR, and CASL
• Attempt to harvest, scrape, or collect email addresses for resale or redistribution
• Use the Service to harass, stalk, or threaten any individual
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Attempt to gain unauthorised access to other user accounts or systems
• Use the Service to collect personal (non-business) email addresses
• Reverse-engineer, decompile, or disassemble any part of the Service
• Exceed rate limits or circumvent usage restrictions through automated means

5. Subscriptions & Billing

BlueWeb offers free and paid subscription plans. Paid plans are billed monthly or annually through Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis.

Each plan includes a monthly credit allowance. One credit is consumed per email search, domain search, or email verification. Unused credits do not roll over between billing periods. Overages are not permitted — once your credit allowance is exhausted, further searches are blocked until the next billing period.

You may upgrade, downgrade, or cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.

6. API Usage

API access is available on eligible paid plans. API keys are confidential and must not be shared publicly or embedded in client-side code. You are responsible for securing your API keys and for all usage associated with them.

We reserve the right to throttle or suspend API access if we detect abuse, excessive error rates, or usage patterns inconsistent with normal operation.

7. Data Accuracy

While we strive for high accuracy in email finding and verification, results are provided on an "as is" basis. We do not guarantee that every email address returned will be deliverable, or that every verification result will be 100% accurate. Email deliverability can change at any time due to factors outside our control.

8. Intellectual Property

The Service, including its design, code, algorithms, documentation, and branding, is owned by BlueWeb and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

You retain ownership of any data you upload to or generate through the Service, including search results, lead lists, and campaign content.

9. Limitation of Liability

To the maximum extent permitted by law, BlueWeb shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service, other users, or third parties. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time by contacting us. We will delete your personal data within 30 days, subject to our data retention obligations.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on our website at least 14 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
